DOJ – Defeat Devices Plea With COBB Tuning Products

The Justice Department and Environmental Protection Agency (EPA) have announced a settlement agreement with COBB Tuning Products to settle claims relating to the manufacture and sale of automotive emission defeat devices in violation of the Clean Air Act. The proposed consent decree, lodged in the U.S. District Court for the Western District of Texas, is subject to a 30-day comment period and final court approval.

The settlement requires COBB to pay a civil penalty of just over $2.9 million, based on the company’s limited ability to pay, and to stop the manufacture and sale of defeat devices.* COBB is an automotive aftermarket parts manufacturer and retailer based in Austin, Texas, which formerly sold its parts in Plano, Texas; Portland, Oregon; and Fountain Valley, California. Global Warming – EPA Issues HFC Enforcement Alert

“After another summer of record-breaking heat, the urgency of the climate crisis continues to accelerate. The Biden-Harris administration is committed to meeting our goals to phase-down HFCs, which contribute dramatically to near-term climate change, so that our children and grandchildren can have a sustainable future,” said Assistant Administrator David M. Uhlmann, of EPA’s Office of Enforcement and Compliance Assurance.

Largest Ever Clean Air Act Fine Imposed on Marathon Oil

The Justice Department and Environmental Protection Agency (EPA) have reached a settlement with Marathon Oil Company* over Clean Air Act violations at the company’s oil and gas production operations on the Fort Berthold Indian Reservation in North Dakota. The settlement requires that Marathon pay a civil penalty of $64.5 million, the largest ever for violations of the Clean Air Act at stationary sources, which include downstream facilities such as oil and gas tank systems. Under the settlement agreement, Marathon will implement extensive compliance measures to achieve major reductions in harmful emissions from more than 200 facilities across the state. Coffeyville Resources Refining Fined $23 Million for Pollution

“The settlement with Coffeyville delivers on the promise of EPA’s new climate enforcement strategy by reducing greenhouse gas emissions equivalent to the annual emissions of 10,000 cars,” said Assistant Administrator David M. Cleveland-Cliffs Steel To Pay $100M for Dearborn Emissions

The modification today of the consent decree requires replacement of the plant’s electrostatic precipitator (ESP) that removes particulate matter from exhaust gases that stem from the plant’s operations and thereby controls visible emissions. It also requires routine testing of the new ESP to assure compliance with applicable emission limits, certain operational parameters and regular monitoring for visible emissions. Continue reading →
