Federal Appeals Court blocks Enforcement of EPA Cross State Rule until Dozens of Power Company Lawsuits are Resolved

EPA Finally Decides 2012 Renewable Fuel Standards
This ongoing Congressional debacle started when EISA established annual renewable fuel volume targets, reaching an overall level of 36 billion gallons annually in 2022, including 16 billion gallons of cellulosic biofuels; 15 billion gallons of conventional biofuels; 4 billion gallons of advanced biofuels; and 1 billion gallons of biomass-based diesel. EISA further specifies that 21 billion U.S. gallons of the 2022 total must be derived from non-cornstarch products such as sugar or cellulose. Continue reading

BP to Pay $426,500, Reserve $240 Million for EPA Violations
The U.S. Environmental Protection Agency (EPA) announced today that several subsidiaries of BP America Inc. have agreed to pay a $426,500 fine, and ensure that more than $240 million in funds are secured to resolve violations of hazardous waste, drinking water and Superfund financial assurance regulations. EPA Ordered to Check State Plans Cutting Haze Pollutants
EPA initially issued a rule in 1999 requiring states to submit regional haze plans. These plans were due in December 2007. National Parks Conservation Association and other environmental groups sued the agency in August 2011 to take action on these plans. Today’s consent decree resolves the litigation. Continue reading

EPA to Study Hydraulic Fracturing Effects on Drinking Water
The U.S. Environmental Protection Agency (EPA) has announced its final research plan on hydraulic fracturing, a controversial technique used to extract natural gas that critics maintain has a huge negative impact on the environment with costs passed on to the public by energy companies. Pelican Oil Refinery Guilty of Clean Air Act Crimes in Louisiana
If the court sentences according to the terms in today’s plea agreement, Pelican will pay $12 million in criminal penalties, including $2 million in community service payments that will go toward various environmental projects in Louisiana, including air pollution monitoring. EPA Grants Emergency Fuel Waiver for Flooded Pennsylvania
In a statement just issued, EPA said that in coordination with the Department of Energy (DOE), and at the request of Republican Pennsylvania Governor Tom Corbett (who receives funding from oil and natural gas companies), EPA Administrator Lisa P. Jackson said that extreme and unusual supply circumstances exist. These problems are likely in EPA’s view to result in a shortage of gasoline that meets federal regulations. The federal waiver will help provide adequate supply of gasoline in the affected area until normal supply to the region can be restored. Continue reading
