DOT Releases Distracted Driving Video on Ohio Cop’s Death

John T. Gordon from Marion, Ohio is the subject of the latest story from U.S. Department of Transportation’s “Faces of Distracted Driving” series. Gordon was a law enforcement officer and father to an 11-year-old boy and a 7-year-old girl. On 18 May 2008, John was riding his motorcycle on Ohio State Route 4 when a young man driving a truck swerved into oncoming traffic. John was struck and died instantly. Records later showed that the driver was using his cell phone at the time of the crash. Continue reading →

BYD Electric Cab Fire and Three Fatalities not Battery’s Fault

An investigation by the Shenzhen government into an accident and fire between a BYD EV and a Nissan sports car that killed three people in May concludes that the battery pack was not at fault, according to a BYD filing with the Shenzhen stock exchange.

A Nissan GT-R traveling at 242km/h – 150 mph – hit a BYD e6 taxi traveling in the same direction at 81km/h. The first impact sent the cab careening out of control, which then resulted in a second impact into a roadside tree, whereupon the e6 completely burned. The cab driver and two passengers perished. Spyker Sues GM For $3 Billion Over Blocking Saab Sale to Chinese

In what could be viewed as the legal equivalent of a Hail Mary pass, Dutch automaker Spyker filed suit against GM in Detroit yesterday, alleging that GM forced the Swedish brand Saab into bankruptcy and then blocked a sale of the company to Chinese investors, which would have ensured its survival. Gibson Guitar Plea Avoids Prosecution for Importing Protected Woods

Toyota Recalls 780,000 RAV4 and Lexus HS 250h Models

Toyota Motor Sales is recalling 2006 to early 2011 model year RAV4 and 2010 model year Lexus HS 250h vehicles sold in the U.S. because the rear suspension can fail, leading to loss of control. Pilot School Owners Go to Prison Over Swiss Bank Accounts

The criminal actions by the Roberts were made possible by UBS, which in February 2009 entered into a so-called deferred prosecution agreement whereby the bank admitted to helping U.S. taxpayers hide accounts from the IRS. As part of the agreement, UBS provided the U.S. government with the identities of, and account information for, certain U.S. customers of UBS’s cross-border business, including the Roberts. TRW Guilty of Price Fixing Seatbelts, Airbags, Steering Wheels

TRW Deutschland pled guilty to price fixing seatbelts, airbags and steering wheels sold to two German automobile manufacturers, and installed in cars sold in the United States yesterday. More than 640,000 Ford Escape, Mazda Tribute SUVs Recalled for Unintended Acceleration after NHTSA Opens Defect Probe

Ford and Mazda are recalling Escape and Tribute SUVs from the 2001 up to the 2008 model year because a cruise control cable can stick and cause unintended acceleration. Since repair parts are not available, dealers will disconnect the cruise control as an interim measure for the safety defect.

The recall was forced when the National Highway Traffic Safety Administration two weeks ago opened an unintended acceleration investigation on 2001 through 2004 Ford Escape and Mazda Tribute SUVs after receiving 99 reports of unintended acceleration from owners. At least one fatality and nine injures are alleged in multiple accidents. Sixty-eight stuck throttle reports are from Ford Escape owners; thirty-one reports are from owners of Mazda Tributes. Ford Recalls 2013 Escapes for Fires; Honda Recalls CRVs

Unintended Acceleration on 730,000 Ford Escape, Mazda Tribute SUVs under NHTSA Scrutiny in New Preliminary Investigation

The Center for Auto Safety had petitioned NHTSA last week to open defect investigations on the V6 Ford Escape and Mazda Tribute models equipped with cruise control. NHTSA opened its own investigation instead, in a move that was required given the seriousness of the allegations that were about to become public.

In a defensive bureaucratic move, NHTSA also denied a CAS request for potentially embarrassing public hearings about the safety agency’s, as well as Ford Motor’s and Mazda’s lack of corrective action thus far. To make matters more complicated and potentially more image damaging for all involved, it is possible that an earlier safety recall resulted in more unintended acceleration accidents on the models involved. NHTSA Prompted Latest Lexus Recall after Web Complaints

The latest Lexus floor mat recall is the result of ongoing complaints filed by owners on the National Highway Traffic Safety Administration’s website. It took another NHTSA inquiry to Toyota back in May to prompt Toyota to action. With virtually instant feedback available at the world’s largest auto safety agency, automakers are increasingly under pressure to fix defects and institute recalls within five business days. NHTSA confirmed this summary in a statement that said in part, “NHTSA requested that Toyota conduct an immediate recall of model year 2010 Lexus RX 350 and RX 450 H vehicles for a serious safety issue involving potential pedal entrapment by the floor mat.” So NHTSA asked Toyota once again to conduct a recall. NHTSA is also requesting additional documentation from Toyota and is considering opening another investigation into whether Toyota met its obligation to notify the agency and conduct a recall in a timely manner.

BP, Marathon, Exxon Mobil, Monsanto, BASF, and Other Hazardous Waste Polluters to Pay for Texas City Superfund Cleanup

The Department of Justice and the U.S. Environmental Protection Agency (EPA) announced have reached an agreement with more then three dozen companies and government agencies that will result in a $56.4 million cleanup of the “Malone Services Company” Superfund Site in Texas City, Texas. The former waste-disposal site is near the shore of Galveston Bay. The deal avoids costly and time-consuming litigation. Continue reading →

BP to Pay $13 Million More in fines for Refinery Worker Deaths

BP Products North America will pay $13,027,000 in penalties and fix workplace violations that led to the deaths of 15 workers at its Texas City refinery in 2005. In September 2005, OSHA cited BP for a then-record $21 million – before the 2010 BP Deepwater Horizon disaster in the Gulf – because of the explosion at Texas City. Volvo Fined $1.5 Million for Not Reporting Safety Defects

Volvo – once known for its safety reputation – now has the dubious distinction of joining Toyota Motor and BMW Group in paying penalties for not reporting defects or violations of U.S. regulations. Louis Dreyfus Energy Pays $4 Million for ‘Stealing’ Natural Gas
